Walter Eggers (hereinafter referred to as the plaintiff) brought this action to recover damages for the breach of a contract for lifetime employment which he alleges Armour and Company (hereinafter referred to as the defendant) entered into with him on or about January 1, 1939. The defendant denied having made the contract, and asserted its invalidity if made. The case was tried to a jury. At the close of plaintiffs evidence the court directed a verdict for defendant upon the ground that there was no competent evidence that defendant had entered into the contract alleged. From the ensuing judgment, the plaintiff took this appeal.
